I am thinking of going to court to claim some money that my previous Contractor/Employer that he owes me.

Basically, i do sub-contract for him and apperently, me and my crew work for his company for over a month and suddenly terminated us for some bullshit reason and now i am trying to collect the money that we worked for him and this is about 6-7k

but everytime i talked to him and ask him about our cheq, he keep saying he send the money to the address that written on my invoice and i've been waiting and waiting but i dont recieve anything from him, while his other employees that work for him received their cheq. so now in my head is that he is just playing with us and his not intend to pay us at all. thats why i am thinking to go to small claim court and sue him and his company. for non paying.

so my question to you guys is; should i go to small claim court and have him and his company sue or do you guys have any other solution for me to get our money that we worked?

please give me a serious advice. really need a help here!

i dont think you can sue him personally if his INC or LTD

you'll have to sue his company, unless he gave you a personal guarantee (you'd need it in writing/ contract agreement)...
